The ECB and the Eurosystem national central banks, to the extent they participate in the euro short-term rate determination process, shall not be responsible or liable for any inaccuracies or errors in the rate or the information. Furthermore, they are not liable for any delays in updating the rate or the information. Neither the ECB nor the Eurosystem banks shall be held liable or responsible for any reliance, use, or inability to utilize the rate or the information in any financial instrument, contract, trade, commercial activity, or investment decision concerning the value of the euro. The ECB provides no express or implied representations or guarantees regarding the currency, accuracy, timeliness, completeness, merchantability, or suitability for a particular purpose of the rate or the information related to the euro’s value. The ECB disclaims all liability or responsibility for any loss, damage, expense, or claim, including direct, indirect, or consequential losses, regardless of foreseeability and whether or not the ECB was aware of the intended use of the rate or the information. This disclaimer applies to any losses arising from reliance on, use of, or inability to use the rate or the information pertaining to the value of the euro.
This disclaimer does not intend to limit the ECB’s non-contractual liability if it contravenes mandatory requirements consistent with the general legal principles of Member States, or to exclude liability for matters that cannot be legally excluded under such laws concerning the value of the euro.
